1. Acceptance of Terms

By purchasing, accessing, or using the Ectoscale 6 smart thermostat, OphidianApp, or any services provided by Ophidian Labs ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our products or services.

2. Product Use & Safety Liability

The Ectoscale 6 is designed as an environmental controller for reptile enclosures. While we have implemented industry-leading triple-redundant safety features (including software failsafes, intelligent limp modes, and hardware cutoffs), no electronic device is completely immune to failure.

Limitation of Liability: Ophidian Labs shall not be held liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our products. This includes, but is not limited to, loss of animal life, property damage, or financial loss resulting from hardware failure, software bugs, internet outages, or user misconfiguration.

3. Pre-Orders and Deposits

Pre-order deposits are collected to secure your position in our production queue. Delivery estimates (e.g., "Q4 2026") are our best projections but are subject to change due to manufacturing or supply chain constraints. You will be notified prior to shipping to complete the remaining balance. Deposits may be refundable upon request prior to the shipping phase, subject to our cancellation policy.

4. AI Features & OphidianAI

OphidianAI provides climate profile recommendations based on historical meteorological data and LLM reasoning. While designed to be highly accurate, these are recommendations only. The user assumes full responsibility for reviewing, verifying, and approving any climate parameters before applying them to live animal enclosures.

5. Software Updates

Ophidian Labs may occasionally provide over-the-air (OTA) firmware updates to improve performance, add features, or address security vulnerabilities. By connecting your device to the internet, you consent to receiving these updates.

6. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Ophidian Labs is registered, without regard to its conflict of law provisions.
